Terms of Service.

By booking with KK Travels Worldwide, LLC (“KKTWW”), you signify that you have reviewed and agreed to the following Terms of Service on behalf of yourself and all members of your traveling party. Some travel arrangements are provided by an independent travel consultant of KKTWW.

1. Safety & Risks
Travel to certain destinations may involve greater risk than others. Client agrees to remain informed on a daily basis as to current news events, as well as review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to confirming and embarking on travel to international destinations. KKTWW does not represent or warrant that travel to certain destinations is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from such travel. Client’s participation constitutes acceptance of such events at Client’s own risk. Further, KKTWW assumes no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of any matter beyond our exclusive control, including but not limited to schedule changes, delay or cancellation of a flight that causes Client to miss all or any portion of the trip, acts of God, acts of government, war, terrorist acts, riots, disaster, weather extremes, or strikes (such events being commonly known as “Force Majeure”). KKTWW has no special knowledge regarding the financial condition of travel suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which Client may wish to travel.

2. Supplier Terms, Delays, and Cancellations
KKTWW acts solely as a booking agent for disclosed principal suppliers including but not limited to cruise lines, hotels, airlines, air charters, transportation companies, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services and is not the source or provider of the travel services (“Supplier”). Each Supplier is an independent entity with its own management and is not subject to the control of KKTWW. Client agrees to abide by the terms and conditions of purchase imposed by any Supplier. Final payment is due prior to departure according to each Supplier’s terms and conditions. Client understands that if terms and conditions are violated, reservations are subject to cancelation, deposits could be forfeited, and penalties will apply. Client is completely responsible for all charges, fees, duties, taxes, and assessments for travel bookings organized by KKTWW.

Unfortunately, flight delays and cancellations are frequent, and there is a risk that a delay or cancellation could impact Client’s trip and/or result in additional expense. Client agrees that KKTWW is not responsible for these losses.

3. Engagement Fee and Ticketing Fee
KKTWW charges a nonrefundable engagement fee to initiate the trip planning process, depending on the complexity of the request. KKTWW may also charge nonrefundable ticketing or change fees for airline tickets. The fees are payable by credit card.

4. Potential Price Increase & Currency Fluctuations
KKTWW will endeavor to provide Client with accurate pricing and explanations of cancellation policies, however client agrees that KKTWW will not be liable in the event of unforeseen price or rate changes or changes in Supplier cancellation policies. Further, by quoting prices to Client, KKTWW is not warranting that no lower price exists, but only that the price quoted is the lowest price known to KKTWW. Currency exchange rates fluctuate on a daily basis and quoted prices are subject to change.

5. Air Travel
Failure to use a reservation may result in automatic cancelation of all continuing and return flights, as well as forfeiture of airfares. Due to enhanced security, it is recommended that Client check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. It is recommended that Client reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights and 72 hours prior for international flights. Certain countries require departure taxes to be paid in cash upon departure.

6. Travel Documents and Foreign Entry
Client agrees to review, in entirety, all travel, itinerary, and other documents related to a trip upon receipt of them, whether from KKTWW or a third party. Any errors, questions, or concerns should be communicated to KKTWW immediately. Client is responsible for obtaining and carrying a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that travelers carry at least two forms of acceptable identification. The information that appears on the identification card must exactly match the data listed on airline ticket(s) and booking records. Certain countries will not permit entry to travelers whose passports expire within six (6) months following their planned return to the United States. Certain countries require notarized permission of both parents of a minor traveling with just one parent. Entry for non-United States citizens may require additional documentation. KKTWW is not responsible for lost payments due to invalid or unissued travel documents (identification card, passport, visa, etc.). Client understands that every country’s requirements for entry and exit are subject to change on a daily basis.

Children and infants also require all such travel documents. The U.S. Customs and Border Protection Agency requires that USA child groups under age 19 arriving by land or sea from contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of a birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.

For Clients with a criminal background please check on entry requirements as different rules apply to each country.

7. Health Requirements
Client is responsible to have proper immunizations and required documentation of such immunizations before travel. KKTWW shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon arrival. Required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which Client must carry for proof of inoculation. Customer understands that KKTWW is not responsible for COVID-19-related requirements that Suppliers and governments may impose or reimpose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. 8. Travel Insurance
KKTWW offers access to services that enhance every travel experience. Travel insurance can help protect Client and their investment. Unless specifically noted, travel insurance is not included in the cost of Client’s itinerary. Without appropriate travel insurance, Client understands and agrees that if any portion of the itinerary is canceled, delayed, or interrupted for any reason, portions of the trip/tour may not be refunded and cancelation penalties will apply, resulting in the loss of monies up to the full cost of Client’s travel booking and related costs. KKTWW is not qualified nor authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. KKTWW is not authorized nor responsible for filing insurance claims.

Certain countries require that foreign visitors present valid medical insurance upon entry. KKTWW is not responsible for denied entry for any reason, including if Client is unable to provide such proof of insurance. KKTWW is not responsible for any costs incurred by Client before, during or after such trip as a consequence of having inappropriate or insufficient travel insurance.

9. Forum, Jurisdiction, Statute of Limitations, and Jury Waiver
This Agreement is considered to be made and accepted in Atlanta, Georgia USA. These terms and the rights and obligations of the parties and any legal action concerning their interpretation, enforcement, or claimed breach of term, obligation or duty as contained or related to these provisions or arising from the terms and conditions shall be interpreted, construed and governed by the laws of the State of Georgia, and any such claims shall be litigated, if at all before a court of competent jurisdiction in Atlanta, Georgia, to the exclusion of any other courts in other country, state, county, city or municipality or locale. Client agrees to consent to jurisdiction and waive any objection that may be available to any such action or proceedings being brought in such courts. Client agrees to submit all claims against KKTWW within 30 days of the final day of the itinerary organized by KKTWW, and Client acknowledges that this 30-day deadline acts as a statute of limitations barring later written or oral claims. Client and KKTWW waive the right to trial by jury.

10. Authority to Sign
Client hereby represents and warrants that Client is at least 18 years old and has authority to sign this Agreement on behalf of Client and all members of Client’s traveling party. Client agrees to indemnify KKTWW against all claims by members of Client’s traveling party that assert that they did not agree to the terms of this Agreement.
